Medicaid notice battle heads to federal appeals court

The U.S. Circuit Court of Appeals for the 11th Circuit will hear arguments on August 12, 2026, regarding whether Florida violated Medicaid beneficiaries’ due process rights by failing to provide clear notices before terminating coverage during post-pandemic Medicaid eligibility redeterminations. The lawsuit, brought by the Florida Health Justice Project and the National Health Law Program, argues that nearly 500,000 class members received confusing or incomplete notices that made it difficult to understand the reason for the termination or whether they should appeal the state’s decision. The trial judge ruled in favor of the Plaintiffs, and barred the state from terminating Medicaid due to income ineligibility until it can provide notices containing certain case-specific information.
