The Florida Trib reports that a panel of three judges of the 11th U.S Circuit Court of Appeals challenged the State of Florida over Medicaid termination notices that often fail to explain why people lost coverage, making it difficult to appeal decisions.
During the hearing on August 12, all three judges expressed doubts that these notices satisfy minimum due process requirements under relevant case precedents, with one judge observing a specific notice sent to one of the plaintiffs was “clearly deffective.”
This case was brought by the Florida Health Justice Project and the National Health Law Program.
