D.D., et al. v. Florida Healthy Kids Corp. and Florida Agency for Health Care Administration: Complaint for Writ of Mandamus

FHJP, in partnership with the National Health Law Program, filed suit in state court on behalf of three children who have been deemed ineligible for Florida’s Children’s Health Insurance Program (CHIP) in violation of Florida law. A state law raised the financial eligibility limit for this program from 200% to 300% of the federal poverty level (FPL) in 2024. Nevertheless, the state officials responsible for implementing this law have refused to apply it to program applicants, including the plaintiffs. The lawsuit asks the court to mandate the state to comply with its own law and apply the 300% FPL financial eligibility limit to the plaintiffs’ applications for CHIP coverage.
