Florida failed to give due process to thousands kicked off Medicaid, court finds

A federal judge has ruled that Florida violated due process when it terminated Medicaid coverage for tens of thousands of families without giving them enough information to appeal. The court ordered the state to stop income-based terminations until families receive clear, case-specific notices — including household size and income used to make eligibility decisions.

This decision stems from a class action lawsuit brought by Florida Health Justice Project and the National Health Law Program, challenging a system that left families confused, uninsured, and unable to fight back. As the court recognized, vague and misleading notices increase the risk that eligible children, parents, pregnant people, and infants lose lifesaving coverage.
